First off... if this morphs into some sort of global mandate WE will not want to comply based solely on setting a bad precedent for future governance which will have the power of undermining the principles of Federalism and sovereignty. That being said, the practice of capital punishment isn't as arbitrary as the ACLU would like us to think. Some might argue that overly worrying about the relinquished rights of the truly guilty is more arbitrary. Whether it's right or wrong, It is part of our system, only the system is flawed and not necessarily the practice itself. Sending innocent people to death is the main reason this should be stopped. The shadows of doubt have proven stronger and more reasonable than bad evidence gathering authorities, DAs and others that are too quick to point a finger to make themselves look good, further their careers or simply to pacify a worried or vengeful public sentiment. All reason which are far from arbitrary.
